Removal and a lawsuit answer different needs

A defamation suit, the “saman fitnah” or “saman malu” people talk about, aims at damages, an apology and an undertaking not to repeat the statement. Malaysian courts do award real sums: in March 2026 the Shah Alam High Court ordered a social-media user to pay RM130,000 to two lawyers over defamatory posts. But a suit takes months or years, legal fees are significant, and the case itself can be reported, which revives the accusation.

Removal aims at something narrower and faster: making the posts disappear from the platforms and from Google. The two are not exclusive. You can start with removal and decide later with a lawyer whether to sue.

Save the evidence before anything disappears

Posts get edited or deleted once the author senses trouble, and a lawyer will need proof of what was published, by whom and to how many people. We build a clean record first.

  • Screenshots showing the full post, the account name, the profile link, the date and the reactions or views
  • The link of every share, group repost and comment that repeats the accusation
  • Who the account belongs to, if known: under section 114A of the Evidence Act 1950, the person whose name or account a publication appears under is presumed to be its publisher, which matters to a lawyer later
  • Any messages where the author threatens to post more or demands something from you

What platforms remove, and what they leave to the courts

Platforms do not decide whether an accusation is true. Their legal forms for defamation exist, but when the facts are disputed they often decline or ask for a court order. What they act on quickly are breaches of their own rules, and defamatory posts very often contain one: a name with an IC number or home address, harassment and insults, a fake screenshot or edited chat, a photo taken without consent, an impersonating account.

Defamation as such is not one of the categories of harmful content under the Online Safety Act 2025, but content that may cause harassment, distress, fear or alarm is, which gives a report on TikTok or Facebook a deadline. MCMC also lists defamation among the online content problems it accepts complaints about at aduan.mcmc.gov.my, and grossly offensive or menacing content can fall under section 233 of the Communications and Multimedia Act 1998; a police report is made in person at a police station.

A letter of demand is a lawyer’s job

A letter of demand (surat tuntutan) asking the author to delete, apologise and undertake not to repeat is often effective in Malaysia, but it must come from an advocate and solicitor. We never send legal threats in our name and never draft them for you. Frequently asked questions

Can you tell me if the post is defamatory?

No. Whether a statement is defamatory, and which defences apply, is a legal question for an advocate and solicitor and ultimately a court. We assess something different: whether each post breaks a platform rule or a Google policy that gives a realistic route to removal, and we tell you that before you pay.

Will removing the posts hurt a future lawsuit?

Not if the evidence is saved first, which is why our first step is a dated record of every post, link and share. Your lawyer can use it later. If you already have a lawyer, we coordinate with them.

Do you contact the person who posted it?

No. We do not message, warn or threaten the author, and we do not post replies. Contact with the other side, including any letter of demand, is for your lawyer. Our work goes through the platforms, MCMC where relevant, and Google.

What if the platform refuses?

Some posts stay up when the platform sees a factual dispute rather than a rule breach. We tell you which copies were refused and why, keep the evidence for your lawyer, and continue with the copies, shares and Google results that can still be handled.
